These Terms of Use ("Terms") govern your access to and use of www.newjyothipublications.com, shop.newjyothipublications.com, the School Login portal and the Eduspring app (together, the "Services"), operated by New Jyothi Publications, Thiruvananthapuram, Kerala ("New Jyothi", "we", "us" or "our").
By using the Services you agree to these Terms. If you do not agree, please do not use the Services. If you are under 18, you may use the Services only with the involvement of a parent, guardian or your school.
1. Use of the Services
You agree to use the Services only for lawful purposes and in line with these Terms. You must not:
- Copy, scan, reproduce, sell or distribute our books, study material or digital content without written permission.
- Try to gain unauthorised access to any part of the Services, other accounts or our systems.
- Upload viruses or harmful code, or interfere with the proper working of the Services.
- Use bots, scrapers or other automated means to collect content or data.
- Impersonate any person or give false information.
- Use the Services in a way that is unlawful, harmful, abusive or offensive.
2. Accounts
School and teacher accounts are issued to authorised institutions. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at info@newjyothipublications.com if you suspect unauthorised use. We may suspend or close accounts that break these Terms.
3. Intellectual property
All content on the Services – including book text, questions, answers, illustrations, designs, logos, the New Jyothi name, software and the Eduspring app – is owned by or licensed to New Jyothi Publications and protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other laws.
We grant you a limited, personal, non-exclusive and non-transferable licence to view and use the content for your own non-commercial educational purposes. No other right is granted.
4. Orders, pricing and payment
- All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise. Delivery charges, if any, are shown at checkout.
- Placing an order is an offer to buy. A contract is formed only when we confirm and dispatch your order.
- We try to keep prices and stock information accurate. If an error is found, we may cancel the order and refund any amount paid.
- Payments are processed through secure third-party payment gateways.
- Bulk and school orders may be subject to separate commercial terms.
5. Shipping, returns and refunds
Delivery times are estimates and may vary by location and courier. If you receive a damaged, defective or wrong book, contact us within 7 days of delivery with your order number and photos, and we will arrange a replacement or refund. Books that have been used, written in or damaged after delivery cannot be returned. Approved refunds are made to the original payment method within 7–10 working days.
6. Educational content disclaimer
Our books and digital content are prepared by experienced educators and follow the prescribed syllabus. However, syllabi and exam patterns change, and we do not guarantee any particular exam result. Always refer to official notifications from the relevant board or examining body.
7. Third-party links
The Services may contain links to third-party websites and apps. We do not control and are not responsible for their content, policies or practices.
8. Disclaimer of warranties
The Services are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties that the Services will be uninterrupted, error-free or free of harmful components.
9. Limitation of liability
To the extent permitted by law, New Jyothi will not be liable for any indirect, incidental or consequential loss arising from your use of the Services. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
10. Indemnity
You agree to indemnify New Jyothi Publications and its group companies against any claims, losses or expenses arising from your breach of these Terms or misuse of the Services.
11. Privacy
Your use of the Services is also governed by our Privacy Policy and Cookie Policy.
12. Changes and termination
We may change these Terms or suspend any part of the Services at any time. Continued use after changes are posted means you accept the updated Terms. We may end your access if you breach these Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Thiruvananthapuram, Kerala.
